TUPE, or the Transfer of Undertakings (Protection of Employment) regulations protect employees' rights when they transfer to a new employer, such as when a school converts to an academy or moves from one academy trust to another.聽The聽regulations mean:

  • It is not possible to change the terms and conditions of staff who have transferred to the new organisation unless certain specific conditions are met.
  • The contract of employment聽is not terminated and continues as if it had been made with the new employer originally.

This page covers:

  • the governing board's role in ensuring compliance with TUPE regulations
  • consulting with and informing staff
  • protected employee rights
